Texas adopts ASME A17.1-2016/CSA B44-16 with state-specific amendments under Texas Administrative Code Chapter 74 (16 TAC Ch. 74). Texas Health and Safety Code Chapter 754 provides the statutory framework. Texas TDLR requires elevator contractor registration (not individual mechanic licensing), with designated Responsible Parties completing continuing education. Elevator inspectors must be licensed by TDLR. Inspection records must be maintained and available for inspection.

02 TESTING

Testing & Inspection Schedule

Routine Inspection
Annual (12 months)

Annual inspections required per ASME A17.1-2016 and Texas Administrative Code Chapter 74. Inspections conducted by TDLR-licensed elevator inspectors (QEI). The Certificate of Inspection must be posted in the elevator car and is valid for one year. Owners must renew annually.

Category 1 Test
Annual (12 months)

Category 1 periodic test per ASME A17.1-2016 Section 8.6.1.2, covering no-load safety device tests and maintenance verification. Required annually; performed by licensed elevator inspector or qualified technician.

Category 5 Test
Every 5 years

Category 5 periodic test per ASME A17.1-2016 Section 8.6.1.6, full-load/full-speed comprehensive safety test. Required every 5 years. Must be witnessed by licensed elevator inspector.

Additional Required Tests

Acceptance inspection
Prior to placing in service (one-time at installation/alteration) — All new elevator installations and major alterations require acceptance inspection by a TDLR-licensed elevator inspector before being placed in service. Plans must be submitted for review.

Fire service functional test (Phase I and II)
Per ASME A17.1-2016 — Firefighter emergency operation functional verification per ASME A17.1-2016 Section 2.27.
Applies to: Elevators with fire service capability
Certificate validity: 12 months
Certificate of Inspection (Certificate of Operation) must be posted conspicuously within the elevator car. Certificate must be current (valid for 12 months from date of inspection).
03 LICENSING

Licensing Requirements

Elevator Inspector TDLR-Licensed Elevator Inspector

Conduct acceptance inspections, routine periodic inspections, and witness required periodic tests for all regulated elevators and conveyances in Texas

Requirements: Valid QEI certification from ASME or NAESAI; TDLR application and license; background check; $199 application fee
Expires: Every 2 years (biennial renewal)
Elevator Contractor Registered Elevator Contractor

Installation, repair, maintenance, and alteration of elevators, escalators, and related equipment in Texas

Requirements: TDLR registration; designated Responsible Party with minimum 3 years elevator contractor experience; general liability insurance minimum $1,000,000 per occurrence (bodily injury/death) and $500,000 per occurrence (property damage); proof of insurance on ACORD form with 30-day cancellation notice provision
Expires: Every 2 years (biennial renewal)
License Authority: Texas Department of Licensing and Regulation (TDLR)
Reciprocity: Texas does not have explicit reciprocity agreements with other states. Out-of-state inspectors must obtain TDLR licensure. Contractor registrations are Texas-specific.

Acceptance Inspection: Required — All new installations and permitted alterations/modernizations require acceptance inspection by a TDLR-licensed elevator inspector before being placed in service. Plans must be submitted to TDLR for review; standard and expedited review options available through the TDLR online inspection reporting system.
05 ENFORCEMENT

Violations & Penalties

Civil penalties up to $1,000 per day per violation; stop-use orders; TDLR enforcement action. Operating an elevator without a valid certificate of inspection or permit is subject to immediate shutdown and civil penalties. TDLR may suspend or revoke contractor registration or inspector license for repeat violations.

Operating Without Permit:

Civil penalties up to $1,000 per day; stop-use order; enforcement action by TDLR. Unregistered contractor violations subject to additional penalties under Texas Occupations Code.

Failed Inspection:

Deficiency notice issued with correction deadline. Device may be ordered out of service pending correction. Escalated enforcement for failure to correct within required timeframe.
