02 TESTING

Testing & Inspection Schedule

Routine Inspection
Annual (12 months) - for elevators in use 5 or more years

West Virginia Code § 21-3C-5 requires county or municipality to ensure that every elevator in use for 5 or more years is inspected annually. Newly installed elevators must receive a certificate of acceptance from the Division of Labor prior to being placed in service. QEI-certified inspectors conduct inspections and issue inspection reports to the Division.

Category 1 Test
Annual (12 months) per ASME A17.1

Category 1 periodic test per ASME A17.1 Section 8.6.1.2, covering no-load safety device tests and maintenance verification. Required annually; conducted by licensed elevator contractor.

Category 5 Test
Every 5 years

Category 5 periodic test per ASME A17.1 Section 8.6.1.6, full-load/full-speed comprehensive safety test. Required every 5 years; witnessed by QEI-certified inspector.

Additional Required Tests

Certificate of acceptance (new installations)
Prior to placing in service (one-time) — The Division of Labor issues certificates of acceptance for newly installed elevators that have been inspected and found to comply with ASME A17.1 and A18.1. No elevator may operate without this certificate.

Fire service functional test (Phase I and II)
Per ASME A17.1 — Firefighter emergency operation verification per ASME A17.1. Elevators shall be controlled by the fire alarm system as required by the WV Division of Labor or the Fire Marshal.
Applies to: Elevators with Phase I and/or Phase II fire service
Certificate validity: 12 months
Certificate of inspection must be posted in the elevator car or readily available for inspection. Certificate issued after satisfactory annual inspection.

Licensing Requirements

QEI-Certified Elevator Inspector West Virginia Licensed Elevator Inspector (QEI required)

Conduct acceptance, annual, and periodic inspections of all regulated elevators and conveyances in West Virginia

05 ENFORCEMENT

Violations & Penalties

Division of Labor enforcement: out-of-service orders, civil penalties, and referral for criminal prosecution for willful violations. Operating a non-compliant elevator without certificate of acceptance is subject to immediate shutdown. License suspension or revocation for repeat violations.

Operating Without Permit:

Elevator ordered out of service; civil penalties; Division of Labor enforcement action. Certificate of acceptance from Division required before any new elevator may operate.

Failed Inspection:

Out-of-service order; deficiency notice with correction timeline. Escalated penalties for failure to correct within required period.
